More details to this question:
she unlawfully entered store and took cash...on video....also, has used co. credit card to fill up her vehicle, and buy lunches. that is verified...all under pending prosecution. she worked 28 hours this month before i found out about this....however, she owes the shop, where she bought some items and charged them, so the difference between the items and the hours worked is $25.00. Can i deduct this from her pay? ( i would LOVE not to pay her, because she owes me alot more than that with the stolen money, credit card charges, and some items stolen).
As a general matter, employees must be paid in full for the services they render. In these circumstances, an attorney might advise you to withhold final payment pending her settlement with you of personal expenses fraudulently charged to the business. You should consult with a local attorney regarding this matter.
