I am going to be opening a childrens birthday party place in Queens, NY. I am going to be serving pizza that is delivered from a pizzeria, cake that is bought from a bakery, soda that is bougth from a store. I make coffee depending on your answer.
As a general matter, if you serve prepared food at retail in New York City, regardless of whether you purchase it or prepare it yourself, you will be deemed to be a "restaurant" and must be licensed.
