QUESTION

How can I get a default judgement reversed?

Asked on May 25th, 2012 on Business Law - Michigan
More details to this question:
My company was sued over an oustanding bill by a partner of the same company that also owns another company in Michigan. He had all the paper work sent to the wrong address and I never knew about the court date. I first found out about the law suite months after when some of my property was siezed. I''ve had several hearings with the judge and he will not even listen to one word our side has to say. What do you do???

It appears that you have taken the appropriate steps to have the default judgment set aside -- namely, filing a motion to vacate the judgment on the ground that you were not given timely notice of the pendency of the action. Notice and the right to be heard is a fundamental principle of our judicial system. It is not clear from your inquiry what the basis is on which the judge has refused to set aside the judgment. You should consult with an attorney and do so immediately.
