My husband has a BestBuy Credit card and had a phone a few years ago that he had a warranty charged on his card for every month. He got rid of the phone, an cancelled the warranty. They still charged him for months without us knowing, and his credit score dropped. After trying over a month to get in touch with BB, they finally sent him a gift card with the amount owed to pay it off and he did. We just got a bill and a warranty was charged and then extra late fees, now his credit is completely down the drain. What can we do? We are young, had a great credit score, and now we cannot do anything for ourselves because of the credit score. Can we take legal matters and sue them?
These kinds of matters are extremely difficult to correct and be very expensive to fix. Because BB correctly reported what its records showed as the amounts owed by you, they may not have any liability under the Fair Credit Reporting Act. It may therefore be necessary for you to sue BB to obtain a declaratory judgment that you do not owe them anything, and then provide a copy of the court judgment to the credit bureaus. If BB will not resolve this with you voluntarily, litigation may be your only resort.
