How do we proceed with a small claim ($1450) against an individual?

We purchased a product on Ebay. We agreed to pay additional $50 for shipping prep-we pay for shipping. He has now asked for an additional $75 which we payed. But we still have not received the product. Ebay said the Buyer Protection through them was voided when we did not use PayPal, but paid with check. He said he did not take PayPal and required a check for payment. What can we do????
You can sue the seller in small claims, as you suggest. You will need to institute the suit where the seller resides or does business. This may be difficult if he is in a different part of the country from you. It will be difficult or impossible to engage the services of an attorney to pursue a claim of this magnitude on a cost-effective basis.
