I am a dog groomer. I make 50% comission.we have been required to split the bathers salary as well. This gets deducted from pay before taxes.

The way it works...the bather makes an hourly wage and depending how many other groomers are there that day...they split the 9 bucks. So if its me and one other groomer...we both would pay 3 and the store pays 3. I groom the most dogs and on average it costs me anywhere from 100-200 per week for a bather (we actually hired a second one for busy weekends) someone told me this is illegal andmy employer could be held responsible to pay me back those wages. I did an average calculation and came up with about 50,000 for the 7 years I have been there. I don''t know what to do. Is this legal? And what do I do if it isn''t? I live in new york.
Arrangements where employees are paid on a piecework basis or share in commissions based on revenue are permissible, as are arrangements where the commission rate is reduced in order to compensate others who contribute to the success of the business. As long as your remaining compensation exceeds the minimum wage, this arrangement is not legally objectionable.
