No papers were sign concerning repair cost - no written estimates or disclosures of terms - everything was by verbal agreement - they were paid $5000 for parts after I was told they could order the parts for that amount- I was told there would be no storage fee - I made repeated phone calls but they never once returned my calls -they claim they are charging me for storage because they tried to call me but I did not answer their calls? - I told them that I would pay them for the repairs but I was told not to pay them until they got all the parts for the repair - I learned that they went ahead with the repairs without consulting me first - tried to resolve the problem last December but they never bothered to call me - when I went to the shop the person in charge had called in sick and was not available - last contact was 4 months ago when I was told to turn over the ownership papers to them - the car is a 1958 Land Rover SWB (collectors value)
There are some aspects of your question that don't really hold together. First, if you did not intend the shop to make repairs, why did you pay them $5,000 for parts? What did you expect that they would do with the parts? Second, why didn't you call or stop by after the lapse of several months or even the first year? What did you think they were doing with your car during this period?
It is customary in the auto trade for a repair shop to charge the customer for storage after the customer knew, or reasonably should have known, that the repairs were complete. You are going to have a problem with your inaction for so long.
