I HAD AN UNLIMITED WIFI PLAN WITH VERIZON

WHEN I CALLED VERIZON TO GET A WIFI REPLACEMENT, I WAS TOLD BY THE REP THAT I WAS ELIGIBLE FOR AN UPGRADE. THE REP SUGGESTED THE 4G WIFI. I INFORMED HER THAT I HAD THE 3G UNLIMITED PLAN AND WAS TOLD BY THE REP THAT I COULD KEEP MY OLD PLAN AND UPGRADE TO THE 4G. I RECORDED THE CONVERSATION WHILE ON SPEAKERPHONE AND I ASKED FOUR TIMES ARE YOU SURE I CAN KEEP MY OLD PLAN AND FOUR TIMES SHE STATED YES! ABOUT 2 1/2 WEEKS AFTER GETTING THE NEW WIFI I RECIEVED A MESSAGE ON THE WIFI DEVICE STATING I WAS OVER 50% OF MY DATA PLAN. WHEN I CALLED I WAS INFORMED THAT I COULD NOT GET AN UPGRADE TO 4G AND KEEP MY OLD PLAN AND SINCE MY OLD PLAN WAS NOT OFFERED ANY MORE I WOULD HAVE TO KEEP THE NEW EXPENSIVE PLAN. I FEEL I WAS EITHER DELIBERATELY LIED TO, TO GET RID OF MY UNLIMITED PLAN. OR VERIZON FAILED TO PROPERLY TRAIN AN EMPLOYEE. I WANT TO SUE THEM IN SMALL CLAIMS COURT FOR OVERAGES I WILL INCUR IN THE FUTURE TO COVER APP.$30 A MONTH THAT I USE FOR MY JOB. DO I HAVE A CASE. THANKS

Of course you have a "case." The problem is how you are going to enforce your position in a cost-effective manner. You will want to seek to resolve this with Verizon's management initially. They may be willing to give you a concession in order to avoid a dispute. If that fails, you will need to follow the dispute resolution mechanism in the Verizon customer agreement you agreed to.
