single axel trailer. after 2 months the trailer had numerous issues. i contacted the manufactuer and they sent new parts to re-inforce the tounge of the trailer that was bending. we are still having issues with the trailer because once we add fuel to the boat, the weigh now exceeds the maximum weight of the trailor. (this was why we wanted the double axel, but the dealer said the single axel was sufficient.) also, we have just found out that the trailor leagally needs brakes and inspection due to the total weight with fuel. this trailor has no brakes and cannot be inspected unless i add brakes. on the day i purchased the boat, how was i able to leave the dealership leagally with no brakes and no inspection? is this the dealer responsibility or mine? do i have any recourse against the dealer? our friend also bought the same boat and trailer from this dealer 2 weeks before i bought my boat and has the same issue with his trailer. can you help me with this issue?
You will need to have an attorney review the contract you signed with the dealer. As a general matter, most such contracts will exclude certain kinds of warranties, including warranties of fitness for your particular purpose. An attorney can assist you in determining the existence of a valid claim and can then assist you in pursuing it.
