I am being sued for conversion, tortious interference with business relations, embezzelment/ breach of fiduciary duty, unjust enrichment. I am a Real Estate Broker that had worked for a company for two years and left about 16 months ago. They claim I am stealing their clients either by having the secretary(s) continue to give me their leads or by me "Hacking" into the companies computers. They are angry because many of my sales since I left are to people that at some time called their office for help in finding a home. (Most of the buyers out there call many offices before they ultimately select a home) Anyway I need to answer their complaint and do not have the means to hire an attorney. Do you think this is just a suit to scare me or intimidate me? This is a very successful company that hates competition apparently and will sink to this level to try to shut me down or scare the girls in the office if they had been doing what they claim.
It is not possible to opine on the objectives of the plaintiffs in such a situation. Much will depend on the truth of the plaintiff's allegations, the economic magnitude of the lost business they have sustained, and any agreements or other undertakings you made while employed by the plaintiff. In most cases, the plaintiff will settle these kinds of matters for an injunction against future violations and some modest monetary payment, but you cannot be certain of that, and you must plan on defending the case. There is absolutely zero chance that you effectively defend this case without the services of an attorney. Get a lawyer now.
