If you are on a unlimited data plan, can ATT slow down your service because you''ve used too much?

More details to this question:
I am on the unlimited data plan with ATT and i received a message saying I''m in the top 5% of usage on the network and they are going to slow my service down unless i use WIFI instead of the ATT network. I started experiencing dropped calls and text messages that never came through.
This is a so-called "net neutrality" question. Under current law, you may lawfully be "throttled," to use the term of art. There are both regulatory and legislative proposals that would change this, but as we stand now, the carrier may reduce the speed of transmission. There should be no loss of calls or data, and any such losses are likely due to routine errors or transmission problems and not to "throttling."
