More details to this question:
This employee was let go and is now going to other employees and having them listen to what was being said. Often times her phone was just laid out for any unsuspecting person venitn to get recorded and having it used against them.
It is unclear what the facts are and about which you are inquriing. For example, it is unclear whether the person doing the recording was a party to the telephone conversations being recorded, had informed the other participants of the recording in advance, etc. Moreover, it is not clear that phone conversations -- as opposed to in-person conversations -- were recorded. If you need an answer to this question, please clarify the factual situation.
