My art director left my design firm, and without permission is now posting work he did while here, billing as "his own" on his Company website.

Is this legal to do? He has logos, website design and advertising, all linking back to my clients websites, and portraying that his Company did this work. He certainly aided in the work's creation, but is misrepresenting his role and his Company by doing this ¿ especially without permission.
An attorney will need to review the precise uses being made by your former employee to determine whether these uses qualify as "fair use" under the Copyright Act.
