My job is telling me that i am on administrative leave without pay because i was arrested for something that has nothing to do with work and have not been convicted yet. i have talked to them and they told me that they wont fire me but I'm not allowed to work until my court date which is in February of next year. I'm wondering if they are allowed to do this legally or if i have a case against them???? is there anything that i can do?
Generally speaking, employment in the United States is on an "at will" basis. That means that the employer may terminate or suspend employment at any time for any reason or no reason at all. The courts generally do not engage in a judicial inquiry into whether the employer's decision was a good one or a bad one, as long as the employer does not engage in prohibited discrimination (such as on the basis of race, religion or national origin).
