QUESTION

Regaining URL when Trademark is Pending

Asked on Sep 18th, 2015 on Business Law - California
More details to this question:
The company I work for has a website domain that was registered under a former employee's personal information rather than the company or CEO information. This disgruntled employee feels that he has the right to ownership to the domain even though he is no longer with the company. The company now has trademarked the name and logo. The former employee was informed of this pending trademark and has moved our domain to a new registrar. The trademark is in the gazette for public announcement. Is there anything that we can do legally to regain our URL?

You could write a demand letter to the former employee to return the registration of the domain to the company.  If he does not do so, then you would sue him for return of company property.  You may also be able to send a take down letter on the domain so that he can't post an unflattering website.
