I received a postcard informing me that I am inclued as a Class Member in the Settlement against a company. I have been given three options:
1. I can submit a seetlement claim to the Settlement Adminstrator to request a share of the Settlement Fund by Aug 6, 2012, which is $40 max;
2. I can remain a Class Member but object to the Settlement by sending a letter identifying myself by Aug 16, 2012; or
3. I can exclude myself from the Settlement and be able to sue AllianceOne about the facts at issue in the lawsuit by mailing a request to the Settlement Administrator by Aug 16, 2012.
It is impossible to know how to advise you without having some idea of what you would be giving up by remaining a member of the class (i.e., by not opting out). In other words, it would be necessary to know the nature and amount of your individual claim that you would give up by not opting out. You will need to have a private consultation with an attorney to make this determination. If you cannot articulate a strong basis for a personal (non-class) claim of significant magnitude, then you may be better off by remaining a member of the class. Your attorney can best advise you on this.
