Would this fall under false/deceptive advertising from an internet service provider?

My internet provider advertises internet speeds STARTING AT 100MB/s. Every page on their website for my address states this. When they were called, I was told my current package provided speeds at or above 100MB/s. The max I have ever received, however, is around 60% of that. Their technician that came to try to fix the problem stated that they had no infrastructure in the area capable of the speeds that were advertised, and that the 60% or so I was receiving was the best they had. When I called to ask why I was advertised and charged for 100MB/s when I was only receiving 60MB/s or less, I was told by their rep that regardless of what they advertise, per their terms and conditions they make no guarantees, and only take action of a customer is receiving 70% or less of what they promise. After reviewing the T&C (not shown or listed on the advertisement pages or in the bill), it states they do not guarantee speeds, but states nothing about a 70% cap.
