QUESTION

Am I being unfairly treated at work?

Asked on Feb 15th, 2013 on Discrimination - New York
More details to this question:
I am an experienced and educated professional who is also a community leader. I am a salaried employee and yet my boss is mandating me to make up time if I have to leave a couple hrs early for child-related reasons. This has happened a total of 6 time in the three months I have been here and I have made up time each time. Now my boss is documenting that it's an issue that I have had six instances of adjusting my schedule (each time for kids). This is not a coverage position, I'm always caught up on my work, and I make up time even when I don't have to. Further, she asked me to start emailing her when I arrive and when I leave for no reason other than she does not like me (no one else has to). The others on my team are rude and I feel like every time I walk into work I'm waiting for the next time someone will bark at me. As much as I hate to say it, there are five us in our program and I am the only one who is white. It's pretty obvious to me. I would like to know what my rights are.

If you have regular hours and you are not there, your boss will have successfully documented a defense to a discrimination claim brought by you.  The issue turns on if there are regular hours to be there.  Being on salary is not determinative of this issue.
