Can an employer confiscate your personal cell phone?

More details to this question:
During an investigation into a Sorority misconduct, Dean of Students, confiscated a student's cell phone who was working in the Dean of students office at the time and viewed private conversations between Sorority members? Is this legal? In addition, Dean of students office used this cell phone conversations as evidence that Sorority was not following the Sorority schedule that was published.

the proper answer would depend upon the circumstances. did the cell phone get used while the person was working for the employer ? did the cell phone conversations 'connect' to the employee's work ? what were the cell phone conversations ? what was the evidence set forth therein which demonstrated that the sorority schedule was not being followed ? please call if we can help. ed dimon, esq. 732-797-1600
