Do I have a case?

More details to this question:
On Friday August 13th I sent my child off to school with his morning transportation driver that is provided by his school. Through an app I able to view his route and receive notifications when he arrives to school. This is the same process for his return to home. It wasn’t until he arrived home that I noticed my mentally/behaviorally challenged child was in a disturbing mood. In order to not cause a meltdown I had to give him his space and time before I could get out of him why he was in that mood. He then informed me in the morning he was in a car accident with his driver. I was shocked and right away checked him, then called his doctor. While waiting for the doctor to give me a call back if I need to have him checked I called the school to find out why I was not called. Since they did not answer I wrote them an email. It wasn’t until 6pm Friday night that I received a call informing me they were so sorry they forgot to call me…. There’s much more!

It appears that your son is well-adjusted and you know how to handle him.  Other than a "disturbing mood," I do not see any "damages" from your story, i.e., did he have to go to the hospital, does he require more therapy, OR are you the one damaged, OR was there any physical injuries.   In other words, did you have to expend any "out-of-pocket" money for his care and recovery?  If not, then you have no case to be filed in court.  This world is not perfect and things happen which may be no one's fault.  You should be lucky your son was not injured.
