More details to this question:
I was arrested in my own home earlier July because I told the police who were responding to a dv call from a neighbor that I would come outside and talk but they were not consented to come into my home. When they arrived my boyfriend was calmly sitting outside while I was inside of my home. They told be that if I did not let them in they would arrest me. After repeating they have no consent to come in I opened my door and an officer pulled me out and arrested me for disorderly conduct and obstruction of justice. Is it not my right to refuse consent. ? I feel I was unlawfully arrested.
the police are required to enter the home and speak with both parties to make sure that both parties are not hurt or are not being pressured. ed dimon, esq.
