More details to this question:
I took my 14mnth old son to brook haven they said nothing was wrong and sent him home with a 101fever I go back the next day cause he got worst still said nothing's wrong the next afternoon they called me to ask how he was doing which I found wierd , I told them he isn't getting better and they said bring him back I took that as a sign that they found something wrong and was trying to cover themselves by having me go back for treatment instead of be honest so I took him to stony brook instead of there and they diagnosed my son with coxsackie and said there was noreason for strep testing because its rare for babies under 3 to get strep. What if I wouldn't have continued to go back and fourth and my son went into convulsions or something ? They sent me home with a fever ! Please get back to me

You need two things to be successful. The first is liability and the second are damages. If there were no damages, namely,  the delay had no effect on your son's health, then not even have to address issue of failing to diagnose.
