downstairs tenant smoking

Hello, me and my husband and daughter rent th upstairs of a unit.I do not smoke but downstairs neibors do.They smoke and there company.It comes up our heat vents and into our homes.my baby granddaughter also lives in our house.we have went so far as to shut off the heat vents and freeze.during these winter months because we dont want to breathe second hand smoke..this is driving me crazy and I dont know wat to do.

You are in a difficult position. You must carefully read your lease to see if there are any prohibitions regarding smoking. You must carefully read your lease to see if there are any prohibitions against smoking in common areas. You must carefully read your lease to see if there are any prohibitions against fellow tenants smoking. If there are no prohibitions, you are in a difficult spot. The landlord is permitting smoking and secondhand smoke is coming into your apartment. I would work with the landlord to have prohibitions against smoking put in place.
