My mother has kidney disease. She is 68 years old. She still works. Her employer makes her work overtime which the additional stress brings on deadly kidney infections. She needs the income and too afraid she will not find another job at her age with her kidney disease. Does she have any rights? Does she have to work overtime? Can she sue?
You need to contact an employment attorney immediately. More information is needed as far as how long your mother has been employed, how many employees her employers has, etc. Your mother may be entitled to FMLA leave to cover overtime if her doctor states that the overtime hours affect her kidney disease. Your mother is entitled to 12 weeks of FMLA leave which can be used intermittently. Feel free to call my office for a free consultation.
