QUESTION

Fired while 7 months pregnant, what can I do?

Asked on Feb 28th, 2015 on Discrimination - Pennsylvania
More details to this question:
Was in charge of billing out accounts for several store branches. Have successfully billed out dollar amounts in the millions over the past two years. Fired for failing to bill two invoices properly, that were billed out a year ago and totaled $1100. No warning or reprimand was given until day of termination. Was asked several times if I planned to return after maternity leave during pregnancy. Was called out in a staff meeting for being pregnant by supervisor before I told employer. Was informally offered a severance package one month before firing if I left early, which I refused because I planned to return after pregnancy.

As you might suspect, you could potentially have a valid Pregnancy Discrimination Act claim against your former employer. These inquiries tend to be very fact intensive.  A good question to ask in your case is how your employer has treated other employees who have made mistakes billing but are not pregnant.  Have those employees been retained?  Such an employee is a comparator for the purposes of discrimination claims. If non-pregnant employees have been retained in similar circumstances, it strengthens the claim that you were discriminated against based on your pregnancy.
