QUESTION

Is it legal to release a psychiatric evaluation?

Asked on Sep 11th, 2015 on Civil Rights - New Jersey
More details to this question:
My principal accused me of writing a violent story in a school environment, which was published on paper, and put me in the spotlight as a threat. My question to you is this: was it legal for him to take the psychiatric report that was filed about me, and then later falsified by himself and the psychiatrist that he had writing it, and release it to the local media? I thought that school psychiatric evaluations were always confidential...?

The school situation makes the case more difficult to analyze. After the school shootings, the courts have opened the door to the psychiatric evaluation if there is the possibility of danger to the staff or other students. The analysis is fact sensitive. We did a similar case at Princeton. Please call if we can help. Ed Dimon
