QUESTION

Re: Dna samples not tested

Asked on Sep 15th, 2014 on Civil Rights - Massachusetts
More details to this question:
I am the mother of Michael Jacques convicted in 2010 of arson of the Macedonia church fire in Springfield, Ma. To make a long story short, there was DNA found on the site in the form of feces. Someone had taken a bowel movement and wiped themselves with a shirt. The Federal Government never tested this. My son was found guilty of a crime he didn't commit because he was home at the time of the fire. I want to know how I can get someone to test this DNA.

If this is a case that was tried in the Massachusetts courts, your son would be entitled by state law to testing of the evidence. If this is a case that was tried in federal court, your son could pursue post-conviction discovery to have the DNA tested.
