QUESTION

Retaliation firing?

Asked on Aug 15th, 2013 on Discrimination - Massachusetts
More details to this question:
My son was just laid off from his job. His boss stated that several other employees told him that my son was saying that he was going to call OSHA about unsafe working conditions. I asked my son who has been on this job for 5 years and he said we all talk about the u safe conditions but I didn't call. A fired employee actually did. The boss stated that they won't fight his unemployment claim so he can collect. We live in Massachusetts. This doesn't seem fair. Should he contact a lawyer or OSHA? Thank you

It all depends from the reason of termination given by the employer. Your son has the right to request (two independant times in a claendar year) a copy of his Personnel Records, and the employer has five days to provide the same. Your son will be able to review his Personnel Recods for any negative evaluations and most importantly the reason of termination given by the employer.
