Department of Health and Welfare came into home and took children away from mom under grounds of neglect while having no proof of allegations. Never informed mom of her rights while lying when they said they would try to help mom and her children find permanent housing. Children taken away that night leaving mom stranded and walking to find a women's shelter at night in an area she was new to and with no clue where children were taken to. Agency has repeatedly changed causes of not letting children come home regardless of mom doing everything that they have asked her to do. This case has and never was a case of abuse or true neglect. This was a situation where a call was made to CPS that a pregnant mother was living in a boarding room with her two children after moving to a new state while she was waiting for help from public assistants. This has been an on going battle with CPS for almost a year now. Mother gave birth a month ago and CPS took that baby from her arms in the hospital

I am not sure if you are referring to a case here in New Jersey. The agency that is involved in NJ in removing children is the Division of Child Protection and Permanency not Dept. of Health and Welfare. To remove children, the Division would have to go into court within 48 hours or less for an emergency application to be approved. They would also have to file a complaint, so when you state that the causes of action have changed, I also do not know what you are referring to, court filings? reports? You also state that the mother moved to a new state, so what state(s) are you exactly talking about. And how could this be going on for a year without there having been a court filing? This question does not make sense to me.
