Son expelled for making "gun like" motion

More details to this question:
My son was just expelled from his Vernon NJ township school for making a gun like motion. In reality he was twirling a pencil near his ear when another student whom he argued with during lunch yelled out "he is making a gun motion send him to juvie" this caught the teachers attention and got him sent to the principals office then expelled. I recorded my 1.5 hour long meeting and it is quite clear my child did nothing wrong

the nj supreme court has given the school broad authority to act for the 'protection and safety of the students and staff'. the shootings in the schools have caused the schools to have 'no tolerance' for 'gun' or 'pretend gun' behavior. this is similar to the 'no tolerance' policy at the airports regarding 'bomb' comments even if made in jest. how old is your son ? has there been any other issues at school ? how long is he expelled ? these are factors the court would take into consideration. ed dimon, esq. 732-797-1600
