QUESTION

what kind of attorney do I need?

Asked on Nov 14th, 2011 on Civil Rights - Oregon
More details to this question:
my son had a skills trainer through the mental health office for our county, that skills trainer had all of his medical information with his diagnosis. She has since told some of her friends that information even after signing the privacy act. This is privileged information and would need written permission to share that information. So I would like to know our rights and what we need to do.

Ethics & Professional Responsibility Attorney serving Salem, OR at Glantz Law Group, LLC

Based on these facts you are reporting a HIPAA violation. While the agency, as well as the individual releasing the information, may be disciplined or fined or both, there is no per se cause of action for that. However, some attorneys have filed actions in these cases and received settlements. I suggest you contact a litigation attorney specializing in personal injury or medical malpractice.
