Work Discrimination

More details to this question:
I was hurt back on 9/17/12 and I had shoulder surgery and still need more medical attention. I am not covered under there doctors any longer, I do have a lawyer for that. I was salary and had 3 weeks vac. On 7/14/13 I will be come an hourly employee. I will lose a week vac. I am also a department head. I am the only department head that has to work every other weekend. Now their are other hourly people that fall under administration that are not made to work every other weekend. When I was on light duty I had to work in my office which consist of two arms. I was not allowed to use my rt arm. I am a Medical Records Director. I had also hurt my neck as well. I went to my HR and my admin and I was told that there were no extra to help me. I did contact HR at Corp and within an hr. I was switched to unit sec. I still had to use my arm there as well. I feel as I am being Discriminated due to my injury. I asked my boss why I had to do every other weekend I was told because I am hourly.

these cases are 'fact sensitive' in that the employer does not have to keep you employed if you cannot do the work. the classic example is a fireman. he/she must be able to carry 165 pound person down a ladder. if the fireman cannot do this 'carry', he/she loses the job as fireman. the employer has no obligation to give them lesser job responsibilities such as driver or dispatcher. be careful in stating that you cannot do the job. ed dimon, esq.
