QUESTION

Is it illegal to sell something online with false information??

Asked on Nov 25th, 2013 on Commercial Litigation - Virginia
More details to this question:
I purchased Playstation 3 from craigslist past friday. The ad on craigslist said the system is in great condition. I went over to pick up the system and the seller turned on the system in his house and it worked fine. However, when I brought it home, the ps3 would heat up really badly with loud noise after about 40 minutes. I am worried if it might break if I don't turn it off after 40 minutes. I contacted the seller and asked him for refund but he refused to using agressive language and insults. I would like to know if it was illegal for him to say that the system is in great condition.

Assuming the seller knew about the problem, he lied to you when he represented that the system was in great condition.  You relied on that lie when you purchased the system.  That is called "fraud in the inducement", and is a basis for you to sue to rescind the contract.
