QUESTION
Can a published work about me be classed as defamation?

More details to this question:
As a child and young adult, I was horribly socially awkward and six years ago, at 22, I was diagnosed with Aspergers Syndrome, a form of autism which impairs the ability to naturally learn social skills. Recently, I discovered that a person with whom I had a class at the age of 19 (three years prior to even hearing about Aspergers) had been writing down my words and actions and turned his notes into a short story about how I am a freak that he desires to kill. He does not keep me anonymous or use an alias. My real name is used and it is even the title of the story. This was then published in a book and is still available for sale and can be viewed on the internet. Because I was not made aware of this as well as the fact that I have a mental illness, is this grounds for a lawsuit?

you may have the grounds for a lawsuit. we would like to discuss our representation of your interests. i do want to be straightforward and state that these cases are expensive to prosecute. the legal fees can be quite substantial. these cases are not done on a contingent basis. you would have to pay the legal fees. does the person who wrote the book have money or assets ? you could spend your hard earned money going after the author. you could win and obtain a judgment. can the author pay the judgment ? ed dimon, esq. 732-797-1600 ext 235
