QUESTION

Can I sue for defamation of character?

Asked on Sep 05th, 2019 on Libel, Slander and Defamation - New Jersey
More details to this question:
I’ve been receiving harassing anonymous text messages for a year and seven months now. Not only did this person continue to harass me with texts from all different types of numbers using fake apps, but started to email my place of employment making false accusations about me to the administrator of my building by email! The person also texted my director of nursing on her personal phone and made false accusations about me!! I’m so embarrassed about all of this! This person told my job I was taking medications from my patients illegally (I’m a nurse) and keeping them for my self, etc! This could ruin my reputation!!!! Long story short, the person slipped up and used her actual email to write an “anonymous” email to my job. Her email address was linked to her Facebook when researched. Come to find out, it is a girl that I worked with two years ago at my old job. I need the harassment to stop! Please help!

You can sue for defamation in civil court. Defamtion cases are difficult and expensive because the burden of proof is on the plaintiff to prove who sent the messages and that there is no truth to the allegations. The defendant can require you to go through all of the required procedures. The defendant may agree to stop the defamtion and you may be able to enter into a settlement. It is impossible to know how the defendant will act. Please call asap to discuss. Ed Dimon, Esq. 732-797-1600
