Can I sue a builder for using a subcontractor that improperly installed my septic system

More details to this question:
I had my home built almost 3 years ago (May 15) and since that time I have had to had my septic tank pumped 7 times. That is an average of once every 4-5 months. The company that pumps my tank told me that the system is not draining properly and that is no fault of my own. The pitch angle on the exit flow pipe is to high thus not allowing the water to flow out properly to the drain field. This is why the tank is filling up so quickly. I have contacted the builder (Adams Homes) who referred me to the company who installed the system.(EZ going) Septic Sytems). They told me everything was ok. I also contacted Bonded Builders, a warranty company who repair defective or improperly installed systems, they will not return my calls or emails. What can I do to get this fixed and recover the money that I have paid to pump out this improperly installed system?

Ultimately the Builder is responsible for the acts of its subcontractors in these cases. At this point if neither are willing to do anything to remedy the situation I would reach out to a lawyer who practices construction defect litigation to assist in your claim. Unfortunatley you probably wont get anywhere without one. If not, it will cause you problems not only now, but down the road if you sell the home. You will have to disclose this issue and probably discount for it if it isnt properly remedied.
