QUESTION

Do I owe the replacement cost for roofing construction?

Asked on Nov 17th, 2015 on Construction Law - California
More details to this question:
I own a dry cleaner (rent)and we are currently undergoing a remodeling construction. The remodeling fees are paid by the land owner. Constructors have put new roofs on our store. But later, I was notified from the land owner that I owe $1,600+alpha for the amount of replacing the pipe because the roof has been melted from the boiler pipe due to its hotness. Every dry cleaners have boiler pipes and of course it is hot. It is the contractor's responsibility for not recognizing the boiler's condition to be hot and that it would affect the roof to be melt in the beginning of the construction. If the issue had been found at the beginning, it would not have cost this much to replace the pipe+roofs around it. The land owner said because the boiler pipe belongs to me, I need to pay for the replacement of the pipe + extra cost for the reconstruction. Is this my responsibility to pay for the replacement?

What does your lease agreement say about repairs and maintenance to the premises?  The lease agreement controls who pays for these costs.   I agree with you that this is a cost that the contractor should cover.  If you have to pay this cost, then you can write a demand letter to the contractor to repair the work or to reimburse you if you have to pay for the costs.  If they don't pay, then sue in small claims court.
