QUESTION
When can you terminate a home rehab contract?
Asked on Feb 07th, 2022 on Construction Law - California
More details to this question:
In 2018 my Father entered into a home rehab and ADU construction contract for his primary residence, but the job is taking much longer than anticipated. I would say the contracted work is around 90% complete, but the remaining items are not getting done in a timely manner. For example, workers will not show up for more than 5 days at a time. There are repeated verbal promises from the contractor as to when the work will be completed, but these dates have come and gone. Can we hold them to hard completion dates or terminate the contract?

It depends on what the terms of the contract are. If there's a term in there stating a completion date, then yes you can hold the contractor to that completion date. But if not, you can ask them to sign a contract amendment providing a firm completion date. Terminating the contract also depends on the language in the contract regarding that. Look at the terms to determine what termination rights you may have.
