Can I sue party for check fraud

More details to this question:
I have received 21 bounced checks totaling close to 75K in an attempt to collect roughly 210K from an expired contract with a mans used auto dealership in the last 12 months. Can I take him to court for check fraud and make him personally responsible since he is the owner and signer of the contract?

California Civil Code § 1719(a)(2) governs this issue and allows you to recover damages in addition to the amounts owed.  Thanks,Jon
