Charges on Credit Card/Debit when you die.

More details to this question:
Brother rented a Car on July 1 sign agreement gave them card.Brother said they put a 250 hold on card.My sister brother and I went to cousin funeral,got back on July on 3.There was and extension on car.July 5 brother died,i got car from my brothers close friend....maybe girlfriend..i got the paper work about rental extension over phone (friend called)brother not buried yet this was on 20 Rental Company called on the 22 told them brother died.They hung up fast and charged my brothers card as a Ck Card Purchase and took 1355.00 that day we still had car.His card is linked to his bank accounts bank chg him 872.00 from savings.This money he gets is Veterans Benefits.Bank was informed by SS that he died.I need to know is there anything I can do,and do I have legal grounds.Brother died with no will.

Regardless of the legal answer, its likely not worth fighting over. Especially when it seems that the car was in fact being used, and not returned after the brothers death.
