QUESTION

Consumer fraud

Asked on Feb 15th, 2017 on Consumer Fraud - Florida
More details to this question:
I baught a 2010 Buick Enclave for my sister 5 days ago from a dealership. They gave me the car fax report that shows its clean and never had any problems but the same day I baught it the AC quit working so the dealership said they would fix it and had it for 2 days and did nothing so I took it to Goodyear and found out that the frame is bent and the AC is leaking, the oil is leaking, the transmission is leaking and the water pump is leaking. I baught the vehicle as is no warranty but the vehicle is unsafe and they should have divulged the frame damage. I would like to sue them for fraud because now it will cost me $1500 to fix the leaks and probable $3000 to fix the frame.

If the Carfax was unaltered - and depending on the papers you signed - AS IS means AS IS....not AS IS unless there are repairs them it means someone else pays for that. Depending on what you want to do you may have a remedy under Fla. Stat. 501.976 BUT you will likely need to retain a lawyer to deal with such an issue and typicially pay out of pocket.
