QUESTION

Dealership: False loan application

Asked on Mar 04th, 2014 on Consumer Fraud - New Jersey
More details to this question:
About two weeks my boyfriend and I went to a dealership. As soon as we walked in my boyfriend told the sale person that "he wasn't working" he replied back saying "don't worry we will get you a car" We got the car and few days later. We find out that the sale person had put false information in order for us to get the car. The sale person put false information on the application. He put "that my boyfriend was working". Now, the bank is giving us problem, and don't want to give us the care car plate and registration. What can we do? we did sign the loan application, but we thought that the information on the application was correct. Can we sued the dealership? By the way we have audio record, when we were talking to sale man manager. Please advice!

the key is the document you signed. did you sign that the boyfriend had a job ? if so, this will be a difficult case to win. you lied on the application. you told a third party [in writing] that the boyfriend had a job. the third party relied upon this false written representation. ed dimon, esq.
