Do I have a case for misrepresentation of a product?

I recently purchased high impact windows (10) from a local installer. I was told the windows were Simonton StormBreaker Plus and, after researching the Internet I was satisfied with the Simonton brand. However, in preparing material to send to my homeowners insurance company, I noticed the label on the windows read, "Norandex PerfeXion". I have spoken to the installer and Simonton and am being told that Simonton sells Norandex under a private label agreement with Norandex Building Products. However, had I researched Norandex, I would not have purchased this brand as the reviews as mediocre at best. I believe the installer should have told me that they sell Norandex. Further, I believe the price I was charged was for the Simonton brand - not the Norandex brand. Please advise if I have a case. Thank you. Patricia Bean

You will need to hire a construction or consumer lawyer to addess this issue within the terms of your agreement. You may need to stop the contractor and demand that they install was was specifically agreed to BEFORE they complete the project.
