More details to this question:
I signed a contract and paid $5000 to this person to do marketing and help me with my business. He did not fulfill the contract. Our contract ended 9/13. I have emails and texts where he says he will pay me back form November and December, 2013. Seeking advice as to whether or not I should file a small claims case? I would not ask for the whole $5000 but would like to get at least $4000 back! Thank you for your time!

No way to tell based on your facts. Biggest issue always is actually collecting money even if you win.
