I am trying to find out if I would have a case against a car dealership here in Panama City. I purchased a used car no warranty and in less than 3 hours the car is broke down on the side of the road. We purchased the car because their advertisement says they have DEPENDABLE used cars. In my opinion 3 hours is not dependable. We have had the car less than a month and still is unable to drive the car. Initially when the car broke down there was NO coolant in the car. One garage we towed the car too said cracked head that would have been from lack of coolant. We have replaced 2 thermostats and they keep sticking also according to the garages is a sign of a cracked head. Since they advertise that they sell DEPENDABLE used cars would this be considered fraud?
Not likely a fraud case from a general advertisement as it is a general non-specific statment. Absent a written warranty, you might have other remedies such a UCC claims for specificl limited warranty, such as "fitness for use" but the problem there is the expense of hiring a lawyer to sue over the issue and I am willing to bet the vehicle at issuse is a sub$5,000.00 "hooptie" type car with high mileage purchased at a buy here-pay here type dealer. The problem with a cracked head may ultimately come down to what happened when the car "broke down", as hopefully the ECU will not show that you continud to drive the vehicle when the lights came on or when then temperature gauge was in the red.
