QUESTION

Is the contract enforceable?

Asked on Apr 22nd, 2015 on Consumer Fraud - New Jersey
More details to this question:
I signed a contract to finish basement with a Home Improvement Contractor. But just found out that the contractor name/addr in the contract is different from the legal name and addr registered against the given license# with Dept. of Consumer Affairs. Is the contract enforceable? I am also being sent invoices for unauthorized additional work done without prior notice or written change order form and threatening immediate payment

Was the work completed as required by the contract? If  The work was completed according to the contract, then the contractor should be paid for the work done. The fact that the  contractor signed the contract as Bill a contractor, but completed the work as Joe the contractor does not change the fact that the work was done according to the contract.  If your position is that the work was not done according to the contract, that you have a much stronger argument.
