Pool work deposit "stolen"

More details to this question:
I have paid 2250/- (have the copy of check cashed) to a swimming pool resurfacing person - referred by some one who i know well. I was not smart to get details except the name and cell phone number. Now he will not perform the work (there is a handwritten scope of work agreement) or return the deposit. Should I hire an attorney or file a police complaint or, please opine.

Whether you hire a civil or crimnal lawyer will depend on the reason the other guy wont do the work and whether you are the only person he has doen this to. You may need to retain a lawyer to see if they can intervene and convince them to return the funds in the interim.
