Vehicle fraud

More details to this question:
I'm a 19 year old college student. I been waiting on the title to a car I put a downpayment on and financing. The check engine light was on and he told me he would fix it. That's been 6 months ago. I cant get tags for it because he keeps giving me the run around about the title. My daddy bought parts for the car only to find out the parts dont match the engine that's SUPPOSED to be in the car. He ran the vin number through carfax and sees that as of Jan. 7th MY car is supposed to be on another car lot in a neighboring county and the mileage is 30,000 more than the as-is contract I signed. Can I legally get my downpayment back from this con artist or am I screwed?

You can get your money back and all of the money that you spent to buy parts that didn't fit.
