I purchased a 5 month old puppy from Petland which was found to have Giardia (internal parasite) within a week of purchase and then my local veterinarian diagnosed several congenital defects within two weeks of purchase. I have filed a claim with Petcare Solutions siting the law but they refuse to give me the option of returning the dog and getting a refund. They say they do not take puppies back and won't refund me the purchase price. They say they will only reimburse veterinarian bills. My household is not ready to deal with a puppy with several disorders needing surgery or "special care" outside of the normal maintenance of a healthy dog. The petstore was located in Plantation, FL and did not explain any possibility of the Bulldog having any congenital defects.
This all depends on the complaince with Fla. Stat. 828 and whether there was a waiver or disclosure of H/C defects and wheher you have a certificate from a licensed Vet. Sounds like they claim the parasite issue didn't render the dog unsellable and there is an H/C waiver and you were outside the time frame. That said, if you are buying a purebred dog, and especially a bulldog, you needto be extra diligent before purchase as they are notorious for H/C issues along with skin problems. You may want to retain a lawyer to send a formal demand etter and see if that changes thier mind, though you will likely have to pay out of pocket for the letter.
