More details to this question:
I spent 1100 fixing my car. the first time driving the car after repairs. The caught on fire while parked and now is a total loss. I tried to work something out with the mechanic, no luck. I removed funds from my account and put a stop payment on the check. He received the check back for insufficient funds. I received a noticed from police a warrant will be served if I don't pay. I would like to file a small claims. Do I have to pay the amount
You should definitely file a case, and respond to the police that the work was shoddy and what happened. Intentionally bouncing a check is a crime, but I am surprised the police are involved. If the payment was procured by fraud, that is a defense.
